§ 54-189. Penalties.

  • (a)

    The provisions of sections 54-204 through 54-207 and 54-209 and 54-210 shall apply except when it is necessary to stop a vehicle in order to avoid conflict with other traffic or in compliance with the lawful direction of a police officer or an official traffic control device.

    (b)

    Every person convicted of a traffic infraction for a violation of any provisions of sections 54-62, 54-76 through 54-93, 54-106, 54-117, 54-118, 54-165, 54-166, 54-204 through 54-207, 54-209, 54-210, 54-222 through 54-226, 54-253 and 54-254, except for a violation of sections 54-204 through 54-207 and 54-209 and 54-210, and sections 54-222 through 54-226 and section 54-254 shall for a first conviction thereof be punished by a fine of not more than $100.00 or by imprisonment for not more than 15 days or both such fine and imprisonment. For a conviction of a second violation, both of which were committed within a period of 18 months, such person shall be punished by a fine of not more than $200.00 or by imprisonment of not more than 45 days or by both such fine and imprisonment. Upon a conviction of a third or subsequent violation, all of which were committed within a period of 18 months, such person shall be punished by a fine of not more than $300.00 or by imprisonment for not more than 90 days or both such fine and imprisonment.

    (c)

    Every person convicted of a violation of sections 54-204 through 54-207 and 54-209 and 54-210 shall be punished for a first offense as follows: parking meters a fine of $10.00; restricted parking a fine of $45.00; and handicapped parking a fine of $50.00. In the event of a second conviction within 18 months, the punishment shall be as follows: parking meters a fine of $20.00; restricted parking a fine of $50.00; and handicapped parking a fine of $100.00.
