§ 42-1. Culverts, drains, conduits; construction, maintenance.

  • (a)

    Approval of plans. No person shall hereafter construct any drain, culvert or other conduit in any of the streets or other public places in the village without first submitting the plans for such construction to the superintendent of public works for approval.

    (b)

    Permit. No culvert, drain or other conduit shall be constructed in any of the streets or other public places in the village until written permission for such construction has been granted by the superintendent of public works.

    (c)

    Obstruction prohibited. No person shall permit any drain, culvert or other conduit constructed and maintained in the streets or other public places in the village in front of or adjacent to premises owned or occupied by him to become clogged with dirt, leaves or other material so as to obstruct the free passage of water.

    (d)

    Cleaning required. It shall be the duty of every owner or occupant of any premises in front of or adjacent to which any drain, culvert or other conduit is maintained, upon receiving notice from the superintendent of public works of the village to clean the drain, culvert or other conduit from any accumulations of dirt, leaves or other material which obstructs or tends to obstruct the free passage of water within 24 hours after receiving such notice.

    (e)

    Violations. The failure of any person to comply with the notice given to him pursuant to this section within 24 hours from the giving thereof shall constitute a violation and the failure on each succeeding day to comply with such notice shall constitute a separate violation.
